LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT IMPORTANT NOTICE: THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY BEFORE SIGNING. BY SIGNING THIS AGREEMENT, YOU ARE VOLUNTARILY RELEASING, WAIVING, AND GIVING UP CERTAIN LEGAL RIGHTS AND CLAIMS YOU MAY HAVE. 1. PARTIES AND PREMISES This Liability Waiver, Release, and Assumption of Risk Agreement (“Agreement”) is entered into between Central Oregon Shooting Sports Association (“COSSA”), including its officers, directors, members, employees, instructors, Range Safety Officers, volunteers, observers, agents, contractors, and affiliated organizations (collectively the “Released Parties”), and the undersigned participant (“Participant”). This Agreement applies to all activities , participation in training programs, competitions, events, and any use of firearms, ammunition, equipment, or COSSA property at or through COSSA, including use of the shooting range and associated facilities located at 27050 US-20, Bend, Oregon or any other locations approved by COSSA(collectively the “Premises”). 2. ACKNOWLEDGMENT OF RISKS Participant understands that the use of firearms and participation in shooting activities are inherently dangerous and may result in property damage, serious bodily injury, permanent disability, or death. Risks include, but are not limited to: accidental or negligent discharge of firearms, ricochets, bullet fragments, firearm malfunction, hearing loss, burns from hot casings or equipment, slips or falls, unsafe acts of other participants, defects in firearms or range equipment, environmental conditions, and delays in emergency medical response. Participant expressly acknowledges that injuries may result from the actions or negligence of other participants, range personnel, instructors, volunteers, or COSSA itself, and that these risks cannot be completely eliminated even when reasonable safety precautions are followed. 3. VOLUNTARY ASSUMPTION OF RISK Participant voluntarily and knowingly assumes all risks associated with participation in shooting activities and presence on the Premises, including risks arising from the inherently dangerous nature of firearms activities, the condition of the Premises, equipment, or COSSA property, the acts or omissions of other participants or third parties, and the ordinary negligence of the Released Parties to the fullest extent permitted by Oregon law. 4. RELEASE AND WAIVER OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY OREGON LAW, PARTICIPANT RELEASES, WAIVES, AND COVENANTS NOT TO SUE COSSA OR THE RELEASED PARTIES FOR ANY CLAIMS, DAMAGES, LOSSES, OR LIABILITIES ARISING OUT OF OR RELATED TO: Participation in shooting activities, training programs, competitions, or events; Presence on or use of the Ver. 06.2026 Premises; Use of firearms, ammunition, or equipment; Any injury, illness, death, or property damage sustained by Participant. This release expressly includes claims arising from the ordinary negligence of the Released Parties. This release does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct to the extent such claims cannot be waived under Oregon law. 5. INDEMNIFICATION AND HOLD HARMLESS Participant agrees to defend, indemnify, and hold harmless the Released Parties from any claims, damages, liabilities, losses, costs, or attorneys’ fees arising out of or related to Participant’s conduct, violation of COSSA safety rules, unsafe handling of firearms, or any injury or damage caused by Participant. Participant further waives any right of subrogation that may exist on behalf of any insurer providing coverage to Participant. 6. PARTICIPANT REPRESENTATIONS Participant represents and certifies that Participant: a) Is at least eighteen years of age, or is accompanied by a parent or legal guardian who has signed this Agreement; b) is not prohibited under federal or Oregon law from possessing or handling firearms; c) Is physically and mentally capable of safely participating in shooting activities; d) Is not under the influence of alcohol, drugs, or substances that could impair judgment or safe firearm handling; e) Will follow all COSSA range rules and safety instructions provided by range safety officers or COSSA personnel. Participant acknowledges that violation of range safety rules may result in immediate removal from the premises. 7. MEDICAL TREATMENT AUTHORIZATION Participant authorizes COSSA to obtain emergency medical treatment or transportation if necessary. Participant agrees to be responsible for all costs associated with such treatment and releases the Released Parties from liability related to efforts to obtain emergency care. 8. PHOTOGRAPH AND RECORDING RELEASE Participant grants COSSA the irrevocable and perpetual right to reproduce Participant’s image, voice and other reproductions (whether by still photograph or video) of Participant’s participation in range activities and to use such images for promotional or educational purposes. Participant waives any right to compensation related to the same. 9. MINOR PARTICIPANTS Participants must be at least eight (8) years of age to enter and participate in any activities at the Premises. If the Participant is under eighteen (18) years of age, the parent or legal guardian signing below acknowledges and agrees to the following: Ver. 06.2026 The parent or guardian consents to the minor participating in shooting activities at the Premises and agrees to supervise the minor at all times and ensure compliance with all safety rules. The parent or guardian assumes all risks associated with the minor’s participation and agrees to defend, indemnify, and hold harmless the Released Parties from claims brought by or on behalf of the minor to the fullest extent permitted by Oregon law. The parent or guardian understands that the enforceability of liability waivers signed on behalf of minors under Oregon law may be uncertain. 10. GENERAL LEGAL PROVISIONS This Agreement shall be governed by the laws of the State of Oregon. Any dispute arising from this Agreement shall be brought exclusively in the courts located in Deschutes County, Oregon. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior oral or written agreements. This Agreement is binding upon Participant and Participant’s heirs, executors, administrators, and assigns and shall benefit the Released Parties and their successors and assigns. This Agreement shall remain in full force and effect from the date of execution and shall apply to each and every entry by Participant onto the Premises, whether now or in the future.
